When is an ABF complaint appropriate?
An ABF complaint is appropriate for disputes up to €200,000 with banks or financial intermediaries — current accounts, mortgages, credit cards, unauthorised transfers, compound interest, credit-bureau reports — once a written complaint to the bank has gone unanswered or received an unsatisfactory reply within 60 days.
How much does an ABF complaint cost?
The filing fee paid to the ABF is €20 and is refunded by the intermediary if the complaint is upheld. The lawyer's fee is agreed in advance, transparently and in proportion to the value of the dispute.
How long does the ABF procedure take?
The Banking and Financial Ombudsman's decision usually arrives within 6-9 months of a complete complaint being filed, much faster than ordinary civil court proceedings.
Do I need a lawyer for an ABF complaint?
Legal assistance is not mandatory but strongly recommended: a well-argued complaint, with the correct reconstruction of the banking relationship and organised documentation, significantly increases the chances of success and reduces the risk of inadmissibility.
What kind of disputes can be brought before the ABF?
All disputes concerning banking and financial operations and services: current accounts, mortgages, personal loans, credit and debit cards, unauthorised transfers, anatocism, usury, fees, Central Credit Register and CRIF reports, salary-backed loans and consumer credit.
Do I have to file a complaint with the bank first?
Yes. An ABF complaint is only admissible after a written complaint has first been sent to the bank or intermediary and 60 days have passed. If no response is received or the response is unsatisfactory, the complaint can be filed with the ABF within 12 months of the original complaint to the bank.
Is the ABF's decision binding?
The decision is not technically binding like a court judgment, but banks comply in the vast majority of cases. If not, the intermediary is publicly reported on the ABF website, and it remains possible to bring the matter before an ordinary court.
